Agreement

These Terms of Service (“Terms”) govern your access to and use of FreeMake at https://freemake.cc (the “Service”). The Service is an AI image generation product.

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Eligibility

You must be old enough to form a binding contract in your jurisdiction (and at least the age required by local law where stricter). If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

What we provide

FreeMake provides tools to generate images from prompts (and, where enabled, other inputs such as reference images) using third-party AI models. Features, models, resolutions, quotas, cooldowns, and credit rules may change and are described on the Site at the time you use them.

Accounts

Some features may work without an account within free-tier limits. Other features may require registration. You are responsible for:

• providing accurate account information;
• keeping credentials confidential;
• all activity under your account.

Notify us promptly if you suspect unauthorized access.

Acceptable use

You agree not to:

• use the Service for illegal, harmful, or rights-infringing purposes (including non-consensual intimate imagery, sexual content involving minors, credible threats, fraud, or malware distribution);
• attempt to probe, scrape, or attack the Service in ways that degrade security or availability;
• attempt to bypass quotas, billing, authentication, or abuse controls;
• misrepresent outputs as human-made where disclosure is required by law or platform rules;
• resell or redistribute the Service in a way that violates these Terms or applicable third-party model policies.

You are responsible for your prompts and outputs and for complying with third-party model providers’ acceptable use and content policies.

Intellectual property

• Our materials: the Site’s branding, UI, software, and documentation are owned by us or our licensors and are protected by intellectual property laws.
• Your inputs: you retain rights to prompts and other content you submit, subject to licenses needed to operate the Service (including processing by us and model providers).
• Outputs: rights in generated images may depend on law, model terms, and how you use outputs. We do not guarantee exclusivity, registrability, or non-infringement of third-party rights.

Free tier, credits, and payments

Paid features may require credits or subscriptions processed by third-party payment providers. Prices, taxes, refunds, and chargebacks follow the checkout disclosures and applicable law. Unless required by law, purchases may be non-refundable.

Credits may expire, may be non-transferable, and may be consumed according to rules shown before generation (for example higher resolutions costing more credits).

Disclaimers

The Service and outputs are provided “as is” and “as available”. AI outputs can be incorrect, incomplete, biased, or unsuitable for a given use case. We do not warrant uninterrupted operation, error-free behavior, or that outputs meet any particular standard.

Limitation of liability

To the fullest extent permitted by law, we and our affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or business opportunities, arising out of or related to your use of the Service.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum permitted by law.

Indemnity

You will defend and indemnify us against claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your content, or your violation of these Terms or applicable law.

Suspension and termination

We may suspend or terminate access if we reasonably believe you violated these Terms, created risk or harm, or need to do so for legal or security reasons.

Privacy

Our collection and use of personal information is described in the Privacy Policy.

Changes

We may modify these Terms by posting an updated version on the Site. Continued use after changes become effective constitutes acceptance of the updated Terms.

Governing law

These Terms are governed by the laws of the jurisdiction where the operator primarily provides the Service, without regard to conflict-of-law rules, except where mandatory consumer protections in your country apply.
